CREDIT CARDS TERMS & CONDITIONS

BNU VISA / MasterCard Credit Card - General Terms & Conditions of Card Use

The use of any Visa/MasterCard credit card (”the Card”) issued by Banco Nacional Ultramarino, S.A Macau (’the Bank’) to the applicant (”the Cardholder”) which expression should include the primary card applicant and those supplementary card applicants who have applied for the Card and been approved at any time is subject to the following terms and conditions:

1.

The term “Card” used in these terms and conditions refers to all Cards issued by the Bank including those replacement or subsequently renewed Cards. All Card(s) shall remain the property(ies) of the Bank and must be surrendered by the Cardholder to the Bank immediately upon request by the Bank or its duly authorized agent.

The Card cannot be used by other than its Cardholder. Upon receipt of the Card, the Cardholder must sign the Card immediately and such signature and/or use of the Card will constitute the Cardholder to be bound by these terms and conditions.

3.

When the Card is used the Cardholder shall sign sales drafts with the signature appearing on the Card. Failure to do so will not relieve him from liability for the use of the Card.

The Cardholder shall assume full responsibility for all credit card facilities extended by the Bank in respect of the Card whether or not within the credit limit and for all related costs, charges and fees The Bank may at its discretion issue supplementary Cards to any person or persons nominated as supplementary Cardholder(s). Both the primary and the supplementary Cardholders shall be jointly and severally responsible and liable for the use of the Card and of any supplementary Card(s). This terms and conditions shall also be binding on the supplementary Cardholder(s).

The Cardholder can use his Card at any contracted Visa/MasterCard merchant outlet to obtain goods and/or services. The Bank however shall not be responsible if the Card is not honoured at any of the aforesaid establishments for any reason whatsoever nor shall it be responsible in any way for the goods and/or services supplied by the merchants. Any complaints from the Cardholder against the merchant establishment must be resolved by the two parties concerned and the existence of any claims or disputes between these two parties shall not relieve the Cardholder’s obligation to settle any sums outstanding with the Bank. Any request by mail or telephone made by a Cardholder to any merchant establishment for the supply of goods or services to be charged to the relevant Card Account shall constitute authority for the merchant to issue a sales draft for the amount to be charged and an acknowledgement that the sales draft, if endorsed “Mail Order” or “Telephone Order”, as the case may be, shall be deemed as having been duly signed by the Cardholder.

The Bank will maintain a credit card account for the Cardholder to which amounts of all sales draft and cash advance vouchers issued pursuant to the use of the Card will be posted. The Bank will also issue a Personal Identification Number (PIN) to the Cardholder for the purpose of obtaining cash advances from the designated ATM networks and/or, subject to the Bank’s approval, performing transactions by electronic means at JETCO ATMs. The use of the JETCO facilities is subject to the Bank’s terms and conditions governing the use of JETCO cards. At no time and under no circumstances shall the Personal Identification Number be disclosed to any other person.

The Card may not be pledged by the Cardholder as security for any purpose whatsoever. The credit limit specified and advised to the Cardholder(s) by the Bank represents a total credit line granted to both the primary card applicant and the supplementary card applicants whether issued instantly or subsequently.

8.

A credit card account statement will normally be sent to the Cardholder monthly, the Cardholder shall settle the amount outstanding in his account including any outstanding interest, fees and charges due to the Bank in accordance with the Bank’s payment requirements described as follows:

8.1

If payment for an account is received in full on or before the due date, no finance charge will be levied. Otherwise, the Cardholder can choose to pay each month an amount not less than the minimum payment which shall be determined by the Bank at its sole and absolute discretion and it shall be at least 3% of the new balance which is the aggregate of all sums outstanding on this Card account or MOP100, whichever is the higher. The statement balance, which has not been fully settled by the due date, will be subject to a finance charge immediately on the next statement date. The finance charge of the statement is calculated on a daily basis for the unsettled transactions and all new transactions debited to the Cardholder’s card account (from the posting date of such transaction(s) and not the due date of statement) at the Bank’s prevailing rate (which rate shall be solely determined by the Bank from time to time) until full settlement to the latest statement is made. The minimum finance charge payable is MOP5. If the credit limit is exceeded, the minimum amount due by the cardholder shall be equal to the whole exceeding amount plus 3% of the credit limit amount.

8.2

If the Cardholder fails to make the minimum payment in full by the due date, a late charge at the rate of 5% per month (subject to a minimum of MOP10) on the minimum payment outstanding will be imposed.

8.3

The Cardholder may use his Card to obtain cash advances from the selected branches of the Bank or other financial institutions and/or Automatic Teller Machines (ATMs) provided or designated by the Bank subject to a finance charge at the Bank’s prevailing rate (which rate shall be solely determined by the Bank from time to time) and a handling charge of 3% of the amount of advances or MOP30 whichever is the higher. Such finance charge will be calculated from the day of advance until the entire amount outstanding of the cash advance balance including the finance charge accrued between the statement date and the date payment has actually been received from the Cardholder and has been settled. In case of cardholder purchase Casino Chips at Casino using his Card or using his card for gambling purpose, the way of finance charge calculation will be same as Cash Advance transaction.

8.4

A service fee of MOP50 will be charged in the case of cheque return or Autopay/Flexipay rejected.

9.

The Cardholder agrees to pay an annual fee for the primary Card, for each supplementary Card issued and for a replacement card or any fee for issuance of the Card which shall be determined by the Bank.

All such fees shall be non-refundable. The Bank also reserves the right to make charges for supplying copies of sales drafts or for any other related services requested by the Cardholder. Such charges shall be subject to regular review and amendment and announced by the Bank from time to time in any manner it deems fit.

10.

All payments to the Bank must be made in Patacas (MOP). Payments by the Cardholder to the Bank shall not be considered to have been made until the relevant funds have been received for value by the Bank. If the Bank decides to accept payment made in some other currencies, payment shall not be credited until the Bank converts such good funds into Patacas at the Bank’s usual rates. Card transactions which are effected in foreign currency shall be posted to Cardholder’s account after conversion into Patacas (MOP) at the rate of exchange determined by the Bank at the time the transaction is processed.

11.

Payment made by the Cardholder to the Bank shall be applied in and towards payment of first, annual fee, outstanding fees, charges and interests; second, cash advances and purchases; and third, current cash advances and purchases.

12.

In addition to general rights provided to the Bank by law or any other agreement, the Bank may at any time and without notice, combine or consolidate the outstanding balance on the Cardholder’s credit card account with any other account which the Cardholder maintains with the Bank and set-off or transfer any sum standing to the credit of such other account in or towards discharge of the Cardholder’s liability to the Bank under these terms and conditions.

13.

The Cardholder may at any time terminate the Card(s) by a written notice to the Bank accompanied by the return of the Card and of any supplementary cards both cut in half. The Cardholder or the supplementary Cardholder may also terminate the use of a supplementary Card by a written notice to the Bank accompanied by the return of the supplementary Card cut in half. The Bank may also terminate the Card(s) at any time with or without cause and with or without prior notice, and may list the number of such cancelled card in its Cancellation Bulletin. Upon the termination of the Card(s) for any reason whatsoever, the cancelled card must be surrendered to the Bank and the whole of the outstanding balance on the Card account together with the amount of any outstanding card transactions effected but not yet charged to the Card account will become immediately due and payable. In the event that the Cardholder defaults in payment, becomes bankrupt, insolvent or dies, the Cardholder or his estate shall be responsible for settling such amount outstanding immediately and shall indemnify the Bank fully for legal fees and other related costs incurred in this connection. The Bank also reserves its right to impose a finance charge at its prevailing rate pending repayment in full by the Cardholder.

14.

The Cardholder shall not permit the use of the Card by any other person. The loss or theft of the Card should be reported to the Bank’s Credit Card Centre immediately in writing or by telex, facsimile or by telephoning and confirming the same in writing. The Cardholder will be responsible for any debit transactions posted to the Card account before written confirmation has been received by the Bank’s Credit Card Centre. Such liability, subject to the determination of the Bank, however, will be limited provided that the Bank is satisfied that the Cardholder has acted in good faith and with due care to safeguard the Card. The issuance of a replacement card will be entirely at the discretion of the Bank.

15.

The Bank may from time to time arrange insurance benefits for Cardholders, with or without the inclusion of their spouses and/or dependent underage children. It is expressly understood that the Bank should not be held responsible or liable for loss and/or damages suffered by the Cardholders, their spouses and dependent children aforesaid. The Bank may amend any terms and conditions of the policy upon written notification of change from the Insurer. For the purposes of this section the Bank shall not be deemed as the Insurer or any agent of the Insurer.

16.

The Cardholder may at certain merchant locations benefit from the Card Reservation Service and Cash Disbursement Service made available by such merchant establishment. Any liability incurred by the acceptance of the Cardholder of such services shall be charged to the Cardholder’s Card account.

17.

The Cardholder must notify the Bank promptly In writing of any change in employment and/or his office or residential address.

18.

The Bank reserves the right to alter and amend this General Terms and Conditions from time to time with prior notice to the Cardholder in any manner the Bank deems appropriate, irrespective of whether the Cardholder has actual notice or knowledge thereof. And the supplementary Cardholder(s) is deemed to be notified of the same by such notice to the primary Cardholder. By continuing to use the Card thereafter the Cardholder shall be deemed to have accepted and agreed to such changes unless the Card is returned to the Bank for cancellation prior to the date such alteration shall have effect.

19.

Cardholder agrees that he may not use his credit card for illegal purposes.

20.

The Bark may (but shall not be obliged to) record and the Customer hereby consents to the Bank recording telephone communication by writing and/or tape recording and/or any other method and such record of any telephone communication shall be conclusive and binding on the Customer.

21.

The Bank reserves the right to levy charges against cardholder to cover the costs and expenses arising out of the operation of the cancelled cardholder’s account with credit balances.

22.

Any notice given by the Bank shall be deemed to be received by the Cardholder the next day following the day such notice is mailed to the address of the Cardholder last known to the Bark.

23.

The Cardholder consents to the Bank’s disclosure, in strict confidence, to any third party including but not limited to any outside debt collecting agency and/or institution of information concerning the Cardholder’s account as the Bank shall consider necessary or appropriate.

24.

In this text, words importing the masculine gender shall include the feminine gender, and words in the singular number shall include the plural number and vice versa.

25.

The word “use” in these terms and conditions shall include the presentation of the Card to obtain goods, services and/or cash advances.

26.

These terms and conditions are written in Portuguese, Chinese and English. In the event of any conflict in interpretation, the Portuguese version shall prevail.

27.

This General Terms and Conditions of Card Use is governed by the Law in force in Macau and the parties concerned agree in submitting all the conflicts arising from the interpretation of these terms and conditions or in connection with the use of BNU Visa/MasterCard Credit Card to the non-exclusive jurisdiction of the Courts of Macau.
